1. Acceptance of Terms
By accessing or using Market Action Center ("the Service"), available at marketactioncenter.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Janissaries LLC, an Arizona limited liability company that operates Market Action Center.
We may update these Terms from time to time. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
2. Account Registration and Eligibility
To use Market Action Center, you must:
- Be at least 18 years of age
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your account credentials
- Be legally capable of entering into binding contracts in your jurisdiction
- Not have been previously suspended or removed from the Service
You are solely responsible for all activity that occurs under your account. You must notify us immediately at contact@marketactioncenter.com if you suspect any unauthorized use of your account.
3. Public Beta Access
Market Action Center is currently offered as a public beta. All product features available in the platform are included for registered users during this beta period, and no credit card is required to use the Service.
We may change, pause, add, or remove features as the product evolves. If we introduce paid plans in the future, we will provide notice before requiring payment for continued access to any paid offering.
4. Educational Analytics Only
Market Action Center is a software workspace for market analysis, journaling, and risk-planning. Rankings, scores, watchlists, entries, stops, targets, exits, catalyst notes, and similar outputs are generalized educational analytics only. They are not individualized recommendations, suitability determinations, or instructions to buy, sell, hold, or avoid any security.
By using the Service, you acknowledge that you must independently evaluate every security, verify current market conditions, and decide whether any trade is appropriate for your own circumstances.
5. Acceptable Use Policy
When using Market Action Center, you agree not to:
- Redistribute, resell, or share any data, analysis, or content provided by the Service without prior written consent
- Use automated scripts, bots, scrapers, or other tools to access or extract data from the platform
- Share your account credentials with others or allow multiple individuals to use a single account
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service to engage in any illegal activity, including market manipulation, insider trading, or fraud
- Circumvent any rate limits, access controls, or security measures
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Transmit any viruses, malware, or harmful code through the platform
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.
6. Intellectual Property
Market Action Center and its original content, features, functionality, design, and branding are owned by or licensed to Janissaries LLC, an Arizona limited liability company, and are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to the platform's user interface, scanner algorithms, AI models, market analysis methodology, and all associated documentation.
You retain full ownership of your trade data, journal entries, notes, and any other content you create within the platform. By using the Service, you grant Market Action Center a limited license to process and store your data solely for the purpose of providing the Service to you.
7. API Usage and Rate Limits
Access to Market Action Center's features, including scanner data and AI analysis, may be subject to reasonable usage limits that protect platform stability, provider budgets, and fair access for all users.
Market data and AI requests are routed through authenticated server-side services. Users do not need to provide third-party data-provider API keys to use Market Action Center. We reserve the right to throttle or suspend access if usage patterns indicate abuse, excessive automated requests, or activity inconsistent with normal platform use.
8. No Advisory Relationship
Your use of Market Action Center does not create an investment advisory, broker-dealer, fiduciary, agency, or similar professional relationship. Market Action Center does not manage accounts, execute trades, monitor your positions, or undertake any duty to update or withdraw a signal, ranking, or plan level after market conditions change.
You remain solely responsible for deciding whether to act on any information shown in the Service and for confirming the liquidity, risk, and suitability of any trade idea.
9. Termination
Either party may terminate this agreement at any time:
- You may close your account at any time by contacting us or using account controls made available in the platform
- Janissaries LLC may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or for any other reason at our sole discretion
Upon termination, your right to access the Service ceases immediately. However, you will have a 30-day window after termination to export your trade data and any other content you've created on the platform. After this 30-day period, your data may be permanently deleted.
Termination does not affect obligations that survive under these Terms.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Janissaries LLC, Market Action Center, and their owners, operators, affiliates, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Trading losses or lost profits arising from your use of the Service
- Loss of data, goodwill, or business opportunity
- Any reliance on information, analysis, or signals provided by the platform
- Service interruptions, downtime, or technical errors
- Actions of third-party data providers or payment processors
Market Action Center is a tools and analytics service. All trading decisions are made solely by you, and you bear full responsibility for the outcomes. Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. Market Action Center disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your specific requirements or expectations
Market data is provided by third-party providers and may be delayed, inaccurate, or incomplete. AI analysis is algorithmic in nature and should not be relied upon as the sole basis for any trading decision. Rankings, scores, entries, exits, stops, and targets can become stale quickly and may not reflect real-time execution conditions.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona and applicable federal laws of the United States, without regard to conflict-of-law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules, except where prohibited by law. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via the email address associated with your account at least 14 days before the changes take effect. We may also post a prominent notice on the platform.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and close your account.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
